Gifts for the Recipient<\/strong><\/h4><p><strong>1.1. Individuals (ZDoh-2):<\/strong><\/p><ul><li>Non-taxable gifts:<\/li><\/ul><ul><li style=\"list-style-type: none;\"><ul><li style=\"list-style-type: none;\"><ul><li>if received by an individual from another individual (who is not the employer or a related party),<\/li><li>if not related to business activity.<\/li><\/ul><\/li><\/ul><\/li><\/ul><ul><li>Taxable gifts:<\/li><\/ul><ul><li style=\"list-style-type: none;\"><ul><li style=\"list-style-type: none;\"><ul><li>gifts from employer or in connection with employment \u2192 treated as fringe benefit (employment income),<\/li><li>gifts related to business activity \u2192 treated as business income,<\/li><li>gifts that are not employment\/business income may qualify as other income (if they exceed \u20ac42 individually or \u20ac84 annually from the same donor).<\/li><\/ul><\/li><\/ul><\/li><\/ul><p>Exceptions:<\/p><ul><li>December gift to employee&#8217;s child up to 15 years old \u2192 non-taxable up to \u20ac42,<\/li><li>fringe benefits up to \u20ac15 monthly \u2192 not included in tax base.<\/li><\/ul><p><strong>1.2. International Aspect<\/strong><\/p><p>If a gift is received by a Slovenian resident from abroad, it is generally taxable only in Slovenia, in accordance with double taxation treaties. Non-residents may claim exemptions under these treaties. <\/p><p><strong>1.3. Inheritance and Gift Tax (ZDDD)<\/strong><\/p><ul><li>Subject to tax: real estate, movable property (including cash, securities), property rights, if the gift is not considered income under ZDoh-2.<\/li><li>Rules for individuals:<\/li><\/ul><ul><li style=\"list-style-type: none;\"><ul><li style=\"list-style-type: none;\"><ul><li>gift of movable property is not taxable if the total value does not exceed \u20ac5,000,<\/li><li>for real estate or higher-value gifts, a tax return must be filed within 15 days,<\/li><li>gifts within 12 months from the same donor are aggregated,<\/li><li>gifts between spouses, children, stepchildren, sons-in-law\/daughters-in-law, and registered partners are exempt.<\/li><\/ul><\/li><\/ul><\/li><\/ul><ul><li>Rules for private legal entities:<\/li><\/ul><ul><li style=\"list-style-type: none;\"><ul><li style=\"list-style-type: none;\"><ul><li>same as for individuals,<\/li><li>institutions operating in the public interest (religious, charitable, cultural, educational, etc.) are exempt if the gift is intended for their activities.<\/li><\/ul><\/li><\/ul><\/li><\/ul><h4><strong>2. Gifts for the Donor<\/strong><\/h4><p><strong>2.1. Individuals<\/strong><\/p><ul><li>Generally have no tax obligations.<\/li><li>Exception: if capital is gifted (real estate, shares, securities), income tax on capital gains may be assessed, unless the gift is to a spouse or child (deferral possible).<\/li><\/ul><p><strong>2.2. Legal Entities and Entrepreneurs<\/strong><\/p><ul><li>Donations: tax non-deductible expense, but tax relief may be claimed.<\/li><li>Gifts to business partners: treated as representation expense, 50% deductible.<\/li><li>Gifts to employees: treated as fringe benefits \u2192 taxed as employment income, expense deductible only if taxed under ZDoh-2.<ul><li>exception: December gift to employees&#8217; children up to \u20ac42 \u2192 fully deductible expense.<\/li><\/ul><\/li><li>Gifts to owners: treated as profit distribution.<\/li><li>Transfer to household for sole proprietors: treated as taxable disposal.<\/li><\/ul><p><strong>2.3.
